A Nurse expert witness is a licensed nursing professional who evaluates whether nursing care complied with accepted standards of nursing practice. These experts are frequently retained in litigation involving bedside assessment, monitoring, triage, documentation, medication administration, patient safety, wound care, infection prevention, and communication and escalation of care.

Nurse expert witnesses may include Registered Nurses (RNs), Licensed Practical Nurses (LPNs), and Licensed Vocational Nurses (LVNs), and may also include specialty nurses whose daily practice is concentrated in a specific clinical setting or service line. In practice, nursing standards vary materially by unit, patient acuity, scope, staffing model, and protocol expectations, which makes correct nurse expert selection critical.

Nurse expert testimony is distinct from physician testimony. Nurse experts do not render physician-level opinions on diagnosis or medical decision-making. Their focus is whether nursing responsibilities were met, including appropriate assessment, monitoring, adherence to policies and protocols, timely communication, and execution of provider orders.

Role of the Nurse Expert Witness
In litigation, nurse expert witnesses evaluate whether nursing assessment, monitoring, documentation, and intervention complied with accepted nursing standards. This includes analysis of vital sign monitoring, recognition of clinical deterioration, medication administration, patient education, care planning, handoffs, and escalation of care to physicians or advanced practice providers when indicated.

Nurse experts commonly assess compliance with facility policies, professional standards, and patient safety practices, including fall precautions, pressure injury prevention, infection control, line and catheter care, wound care, and documentation practices.

Key Issues in Nursing Litigation

Nursing matters commonly turn on whether changes in patient condition were appropriately recognized and acted upon, whether monitoring was adequate, and whether communication and escalation occurred in a timely manner. Disputes frequently involve documentation quality, missed or delayed reporting of abnormal findings, failure to implement ordered interventions, medication errors, failures in handoff communication, and failures to follow unit protocols.
